Целью инженерных изысканий является под- готовка исходных данных по инженерно-геологи- ческим условиям, необходимых для уточнения и принятия проектных решений строительства морского добычного комплекса и объектов обу- стройства ШГКМ в рамках технико-экономическо- го обоснования проекта освоения месторождения. В декабре 2011 года принято решение об инве- стировании и начале строительства не только самого газопровода, но и инфраструктуры: жилые помещения, заводы по производству сжиженного газа. Для работпо строительству непосредствен- ноШтокмановскогоместорождения и береговой ин- фраструктуры, производственных мощностей по перекачке и сжижению природного газа российским и иностранным подрядчикам необходимо будет оборудование, техника, а также материалы. Более чем 90% из этого будет доставлено из-за границы, а, следовательно, подвержено процедуре таможен- ного оформления. Ïðè ðåàëèçàöèè ãëîáàëüíûõ ïðîåêòîâ, ñâÿçàííûõ ñ îñâî- åíèåì Àðêòè÷åñêîãî øåëüôà, íåïîñðåäñòâåííûì ó÷àñòíè- êàì òàê èëè èíà÷å ïðèõîäèòñÿ ðåøàòü âîïðîñû, òðåáóþùèå âçàèìîäåéñòâèÿ ñ ïðåäñòàâèòåëÿìè òàìîæåííûõ îðãàíîâ. Ãðàìîòíî ïðîðàáîòàííàÿ ïðîöåäóðà òàìîæåííîãî îôîðì- ëåíèÿ è ñîáëþäåíèå âñåõ íþàíñîâ â êîíå÷íîì ñ÷åòå îá- óñëîâèò îïåðàòèâíîñòü ðåàëèçàöèè Âàøèõ ïðîåêòîâ. Îïèðàÿñü íà ñâîé îïûò ðàáîòû â ðàìêàõ ïðîåêòà îñâî- åíèÿ Àðêòè÷åñêîãî øåëüôà, õîòåëîñü áû â îáùèõ ÷åðòàõ îáîçíà÷èòü îñíîâíûå ìîìåíòû, ñâÿçàííûå ñ âîïðîñàìè òàìîæåííîãî îôîðìëåíèÿ. 1) Недопонимание иностранным контрагентом требований по заполнению коммерческих и транс- портных документов, а также необходимости пре- доставления документов и сведений: Ðåøåíèåì Êîìèññèè òàìîæåííîãî ñîþçà ¹ 257 îò 20 ìàÿ 2010 ãîäà «Îá Èíñòðóêöèÿõ ïî çàïîëíåíèþ òàìî- æåííûõ äåêëàðàöèé è ôîðìàõ òàìîæåííûõ äåêëàðàöèé» áûëè ðåãëàìåíòèðîâàíû ïðàâèëà çàïîëíåíèÿ äåêëàðà- öèé íà òîâàðû, ïåðå÷íè äîêóìåíòîâ, íåîáõîäèìûõ äëÿ òàìîæåííîãî îôîðìëåíèÿ, è ò.ä. Îäíàêî, äàæå â ðåøå- íèè êîìèññèè ñîäåðæàòñÿ îãîâîðêè. Èòàê, ðàññìîòðèì, îáùèå ïîëîæåíèÿ: Íàñòîÿùàÿ Èíñòðóêöèÿ î ïîðÿäêå çàïîëíåíèÿ äåêëà- ðàöèè íà òîâàðû (äàëåå - Èíñòðóêöèÿ) ðàçðàáîòàíà â ñî- îòâåòñòâèè ñî ñòàòüåé 180 Òàìîæåííîãî êîäåêñà òàìî- æåííîãî ñîþçà (äàëåå - Êîäåêñ) è îïðåäåëÿåò ïîðÿäîê çàïîëíåíèÿ äåêëàðàöèè íà òîâàðû (äàëåå - ÄÒ). Çàêîíîäàòåëüñòâîì ãîñóäàðñòâ-÷ëåíîâ òàìîæåííîãî ñî- þçà ìîãóò áûòü óñòàíîâëåíû äîïîëíèòåëüíûå òðåáîâàíèÿ ïî çàïîëíåíèþ îòäåëüíûõ ãðàô ÄÒ â çàâèñèìîñòè îò êàòåãîðèé òîâàðîâ è çàÿâëÿåìûõ òàìîæåííûõ ïðîöåäóð. Îñîáåííîñòè çàïîëíåíèÿ îòäåëüíûõ ãðàô ÄÒ â ñëó÷àÿõ, ïðåäóñìîòðåííûõ ñòàòüåé 194 Êîäåêñà, îïðåäåëÿþòñÿ òàìî- æåííûì çàêîíîäàòåëüñòâîì òàìîæåííîãî ñîþçà è (èëè) çà- êîíîäàòåëüñòâîì ãîñóäàðñòâ-÷ëåíîâ òàìîæåííîãî ñîþçà, ò. å. òðåáîâàíèÿ ìîãóò ðàçíèòüñÿ.  ðàçíûõ ñòðàíàõ - ðàçíûå íîðìû è òðåáîâàíèÿ ê çàïîëíåíèþ èíâîéñîâ, ê ïåðå÷íþ äî- êóìåíòîâ îò÷åòíîñòè.  ñâÿçè ñ ýòèì íåðåäêî âîçíèêàþò ñëó÷àè, ïðè êîòîðûõ èíîñòðàííûé êîíòðàãåíò ïðîñòî íå â ñîñòîÿíèè ïîíÿòü, ÷òî îò íåãî õîòÿò ïîêóïàòåëè: - íå âïèñàí â ñ÷åò íîìåð äîãîâîðà, - íåò ïå÷àòè èíîñòðàííîãî þðèäè÷åñêîãî ëèöà íà êàêèõ ëèáî äîêóìåíòàõ, ïåðåñûëàåìûõ ïî ýë. ïî÷òå è ò.ä. Áîëåå òîãî, äîâîëüíî ÷àñòî èíîñòðàííûõ êîíòðàãåíòîâ ïîâåðãàåò â óíûíèå òðåáîâàíèå òàìîæåííûõ îðãàíîâ ïðå- äîñòàâèòü äîêóìåíòû è ñâåäåíèÿ, òàêèå êàê ïîëíóþ òåõíè- ÷åñêóþ äîêóìåíòàöèþ íà òîâàðû, ñâåäåíèÿ îá îðãàíèçàöèè- ïðîäàâöå, âïëîòü äî ñîñòàâà ó÷ðåäèòåëåé è áóõãàëòåðñêîãî áàëàíñà. Ïîýòîìó âî èçáåæàíèå ïðîáëåì â íåäîïîíèìàíèè ðåêî- ìåíäóåì èíîñòðàííûì êîíòðàãåíòàì íàïðÿìóþ âûõîäèòü íà During implementation of global projects, connected with exploration of the Arctic shelf, direct participants in any way have to solve the questions with representatives of the customs office. And properly developed procedure of customs clearance, taking into consideration all details, will finally provide operational efficiency of Your projects. Basing on the experience of working within the frameworks of the project on Arctic shelf development, I would like, in general words define the moments, connected with the issues of customs clearance. 1) Lack of understanding by foreign counter-agent of the requirements to filling in commercial and transport documents, as well as the necessity to present documents and information: By the Decision of the commission of customs union ¹ 257 from the 20 th of May 2010 On instructions of filling in customs declarations and forms of customs declarations there were defined the rules for filling in declarations for goods, as well as lists of documents, needed for customs clearance, etc. Nevertheless, even decision of the commission contains some stipulations. So, let’s consider general provisions: The present Instruction concerning the order of filling in declaration for goods (hereinafter referred to as Instruction) was developed in accordance with the Article 180 of the Customs Code of the Customs Union (further referred to as the Code) and defines the order of filling in declarations for goods (further - DG). The legislation of the countries - members of Customs Union can establish additional demands to filling in separate sections of DG, depending on the category of goods and declared customs procedures. In December 2011 there was taken decision concerning investing and beginning of construction works of not only pipeline itself, but also infrastructure: living houses, LNG plant. For construction works of Shtokman field and onshore infrastructure directly, as well as production capacities on gas pumping and liquefying, done by Russian and foreign subcontractors, there is the need for equipment, technique, as well as materials. Over 90% of the mentioned above, will be transported from abroad, and, as a consequence, will go through the procedure of customs clearance.
